(Revised 11-8-2019 11:38 PM EST) Explaining That In Kentucky It Would Be Considered A Misdemeanor Criminal Mischief Charge That Would Have To Be Issued; But Still Should Have Been Faced With Arrest!

While the cops say misdemeanors in Kentucky are not able to allow for arrests- this is a BOLD FACED LIE- Kentucky Statutes 431.015 – Citation for misdemeanor — Failure to appear - (b) A peace officer may make an arrest instead of issuing a citation for a misdemeanor committed in his or her presence if the misdemeanor is: 2. This would seem to fit the situation; as in Kentucky -Assault- would need to have Physically Clear Injury; so this Assault in Kentucky would fall under "criminal mischief" and at the least - Criminal Mischief in the Third Degree The least serious of criminal mischief offenses, criminal mischief in the 3rd degree is defined as intentionally or wantonly defacing, destroying, or damaging any property or tampering with property to knowingly endanger someone or someone’s property. Criminal Mischief in the Third Degree is a Misdemeanor in Kentucky and it would just matter how expensive the property was; if it was over $1,000 then it would become Criminal Mischief in the First Degree according to the Statues, and that would be a felony.
